Alright, so essentially, azmagictrader and I agreed on a trade and exchanged addresses. The trade was all ready to go until he informed me that the LED was not NM or M, but was in fact heavily played and he still wanted to value it at NM. I don't mind trading for less than NM cards in most situations, but I expect (as per noted in my thread) to be informed that the card(s) are not mint whenever a trade value is being assessed.
First, he said that the LED has slight play, and that seemed fishy so I asked for a scan or decent picture to judge for myself. He sent the following:

After sending that photo he said that it is Played. I responded, asking him for a better photo so I can actually see what I'm looking at, and that even though I can only see the back of what is allegedly a Lion's Eye Diamond, I can tell that it is worse than SP. So then he sends me this:

And in the email, he says, "here is a much better pic lol. i would say its EX." I was still fine with trading for the LED, but I offered him $35 in value instead of $46.53. He then replies that he "picked up a lot of stuff he needed" and isn't interested in trading anymore. I inform him that backing out of a trade after it's already agreed upon is a pretty big offense, and then he noted, "so even though the LED is trashed, you still want it?" and then he informs me that he sold the LED. So the Lion's Eye Diamond (which I never even got to see for certain) went from NM to SP to P to EX to Sold. Okay, fine. He sold the main card in a rather large trade. I figured I could still make the trade work out. He offered to remove the LED from his side of the trade if I removed Snapcaster and Sorin, Lord of Innistrad from my side of the trade. I agreed to this and asked him to re-confirm the current trade, and then he responded and told me that he also sold the Sneak Attack. So the 2 main cards that I was aiming to get out of this trade are now unobtainable. I'm not even interested anymore, but I don't know what to do.

I just want to make sure I understand this... azmagictrader, you confirmed the trade and then backed out and are unwilling or unable to deliver your half of the trade? |

The issue here is strange. According to the rules you need both addresses and contents of the trade before it is considered a "confirmed" transaction. Because Knyght was still asking about condition when the addresses were exchanged there was no confirmed deal and nobody was under any obligation to send at the point the addresses were posted - the card condition is part of the content. Had Knyght not mentioned this he would not have been able to file a BTR for misrepresentation of good.
For reference:
The wasted time is unfortunate but because the negotiations were still happening the case is dismissed. azmagictrader was recently suspended for sending a very similar PM to a staff member (me). After the suspension was over he sent this PM to Knyght. Because of this he will receive his second suspension and due to such poor communication and hostile tone he will be banned from participating in Market Street. |
